Terms of Service
The terms and conditions that govern your use of this website and the services M&L HVAC provides.
Last updated: August 26, 2026
These Terms of Service ("Terms") are an agreement between you and M&L HVAC, LLC ("M&L HVAC," "we," "us," or "our"), a heating, cooling and refrigeration contractor located at 1317 N San Patricio St, Goliad, TX 77963. They govern your use of mlhvacllc.com and the services you request through it. By browsing this site, submitting a form, or engaging us for work, you agree to these Terms. If you do not agree, please do not use the site.
How we handle the personal information you give us is covered separately in our Privacy Policy, which is incorporated into these Terms by reference. Your rights over that information — including how to opt out of the sale or sharing of it — are set out in the Your Privacy Choices section of that policy.
1. Who We Are and What We Do
M&L HVAC, LLC provides residential, commercial and industrial heating, air conditioning and refrigeration services in Goliad, TX and the surrounding South Texas communities listed on our Service Areas page. Services include diagnostics, repair, installation, replacement, preventative maintenance and emergency response.
Texas contractor licence: TACLA151073C. Our licence number also appears in the footer of every page of this site.
All services are subject to availability, to the equipment and access conditions at your property, and to our service area. We reserve the right to decline work we cannot perform safely, lawfully or to our own standard.
2. Estimates, Scheduling and Cancellation
Appointments are scheduled based on availability, and we make every effort to arrive within the window we give you. Emergency and after-hours calls are prioritized by urgency, not by order received.
- Estimates reflect the information available at the time of assessment. If we discover additional work once the system is opened up, we will tell you and get your approval before proceeding.
- Please cancel or reschedule at least 24 hours in advance where you can. Missed appointments without notice may be subject to a service-call fee.
- Emergency and after-hours service is available and may be billed at after-hours rates, which we will disclose before dispatch.
- Submitting a form on this website is a request for service, not a confirmed appointment. A booking exists only once we have confirmed it with you directly. For a genuine emergency, call (361) 419-1837 rather than using the form.
3. Pricing and Payment
Pricing is provided up front, before work begins. Payment is due on completion of the work unless we have agreed otherwise in writing.
- We accept major credit cards, checks, and approved financing.
- Card payments are processed through our payment provider's own PCI-DSS compliant systems. We do not accept card numbers through this website and no page here contains a card-entry field.
- Financing, where offered, is provided by a third-party lender on that lender's own application and subject to that lender's approval and terms. We are not the lender and we do not decide your application.
- Any change to the agreed scope of work will be communicated and approved before we proceed.
4. Warranties and Guarantees
We stand behind our workmanship. Labor warranties and any parts warranty vary by service type and are disclosed at the time of service; manufacturer warranties on installed equipment are provided by the manufacturer on its own terms and require registration and, in most cases, documented annual maintenance to remain valid.
Warranties do not cover damage caused by misuse, neglect, deferred maintenance, power surges, flooding, storm damage, pest or rodent damage, or work performed on the system by anyone other than us.
Disclaimer. Except for the express warranties described above and any warranty that cannot be disclaimed under Texas law, this website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components.
5. Limitation of Liability
To the maximum extent permitted by Texas law, M&L HVAC, LLC shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages arising out of or relating to your use of this website or our services — including lost profits, lost business, spoiled inventory, or loss of use — even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to any particular service shall not exceed the amount you actually paid us for that service. Nothing in these Terms limits liability for gross negligence, willful misconduct, personal injury or death, or any other liability that cannot be limited under Texas law.
6. Your Use of This Website
Content on this site is provided for general information only. It is not professional advice, and it is not a substitute for an on-site diagnosis by a qualified technician. Do not attempt repairs on refrigerant-carrying or high-voltage equipment based on anything you read here.
You agree not to:
- Submit false, misleading or fraudulent information through any form on this site
- Submit another person's contact details, or a phone number you are not authorized to give us
- Use automated means to scrape, harvest, overload or interfere with the site or its forms, or attempt to defeat our spam protection
- Attempt to gain unauthorized access to any part of the site, its servers or any connected system
- Use the site for any unlawful purpose or in violation of these Terms
We are not responsible for the content, accuracy or practices of third-party websites linked from ours, including our financing partner's application and manufacturer sites.
7. Intellectual Property
This website and everything on it — text, photographs, graphics, page layouts, the site's design and its underlying code, and the M&L HVAC, LLC name and logo — are owned by M&L HVAC, LLC or its licensors and are protected by United States copyright, trademark and other intellectual property laws.
You may view this site and print or download individual pages for your own personal, non-commercial use in evaluating or arranging our services. You may not otherwise copy, reproduce, republish, distribute, modify, frame, sell or create derivative works from any part of it, and you may not use our name, logo or trademarks without our prior written permission.
Manufacturer names, equipment brand names and third-party logos that appear on this site are the property of their respective owners and are used only to identify the equipment we service.
8. Electronic Communications and Text Messages
When you contact us through this site, you consent to receive communications from us electronically, and you agree that electronic communications satisfy any legal requirement that a communication be in writing.
We send SMS or text messages only to numbers whose owner has checked the separate consent box beside the request — consent to receive texts is never pre-checked, never bundled with anything else, and never a condition of buying any service. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. Details are in the Privacy Policy.
9. Governing Law and Venue
These Terms and any dispute arising out of them, this website, or the services we provide are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
You and M&L HVAC, LLC agree that the exclusive venue for any action arising out of or relating to these Terms shall be the state or federal courts located in Goliad County, Texas, and you consent to the personal jurisdiction of those courts. Before filing anything, we ask that you contact us so we can try to resolve the matter directly — most issues are settled with a phone call.
10. Accessibility
We are working to keep this site usable by everyone, including people using assistive technology. Our commitment, the standard we aim at, and how to reach a person if you hit a barrier are described in our Accessibility Statement.
11. Changes, Severability and Entire Agreement
We may update these Terms at any time. The “Last updated” date above always reflects the current version, and continuing to use the site or our services after a change means you accept the updated Terms.
If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce a provision is not a waiver of it.
These Terms, together with the Privacy Policy and any written estimate, invoice or maintenance agreement we sign with you, are the entire agreement between us regarding this website and the services described here.
